Nevada State Supreme Court Stops Shell Game
 

Today the Nevada Supreme Court issued its ruling in both the Secretary of State v. Burk and the Child v. Lomax cases. The Court upheld the passage of the 1996 amendment which placed term limits on all members of the state legislature and local offices.

 

The court accused the candidates of resorting to “ingenuity to create ambiguity” that does not exist in the amendment and that is insufficient to defeat the amendment’s clear language. 

 

The Secretary of State v. Burk case addressed term limits for local office holders. The Court ruled in favor of the 1996 amendment that term limits on local offices are valid and that this current session would constitute their last in office.

 

The Child v. Lomax decision upheld the 1996 passage of term limits on the Nevada State Legislature, which passed with 70 % of the vote. Originally both were one case; however the court ruled two weeks ago to separate the two.

 

US Term Limits President, Philip Blumel, had this to say about the decision: “This was certainly a slap in the face for Senator Reid and his henchmen. Their effort to ignore the will of Nevada voters should not go unpunished. US Term Limits made the decision early that this was an effort by the politicians to use the courts to undo the will of the people. We couldn’t be happier of our decision to monitor this case and file amicus briefs protecting the voters from deceitful politicians.”

 

The opinion was written by Chief Justice Mark Gibbons who is up for reelection this year. These decisions now hold positions of permanence in the court’s jurisprudence and will set legal precedent nationwide.

 

“This is certainly a great day for the citizens of Nevada,” concluded Blumel. “US Senator Harry Reid can now join in the fraternity of failed term limits repeal scams. I am sure California Legislators Perata and Nunez will welcome him with open arms. Politicians in states with term limits, please take note, you will not succeed in repealing term limits.”

 

Nevada is one of 15 states that has term limits on their state legislature.
